Is it considered sexual assault if the man influenced me to use crack cocaine and ?

sherri c asked:

he manipulated me to have oral sex while I was high and unable to properly function? I am a married woman and never would have done this sober. He knows I have been struggling with my addiction for a long time and used that to his advantage.
Alsom could I sue him for ruining my marriage?

It sounds like you need to get some help for your addiction. It has gotten to the point that you are trading sex for dope. You have ruined your marriage, not him.

He ‘manipulated’ you. This does not mean complete force or rape.

I am sympathetic towards you, but women too often use assault as an excuse when they get into a situation they wish they hadn’t.

Why don’t you just SUE YOURSELF?
What are you doing around people that smoke crack when you are in recovery?

Yes, but you might lose the case if the other attorney can prove that you created an inviting atmosphere by smoking crack with him in the first place.
You would also have to accept possible jail time for possession and use of crack cocaine, accessory after that fact if he is a dealer and had large amounts fo the drug in his possession at the time.
Other considerations:
Where were you? at his house, yours or a neutral place?
If you are married, why did you agree to meet this man?
Can it be proven or disproven he is a lover?
Are you now or have you been in re-hab?

As for suing him…
It would air all your dirty laundry for the public to see
It would cost alot of money and time
If your marriage is over, you will quite bluntly, need your money for your divorce lawyer.

Only if you were so wasted that you were unable to consent. Persuasion is not the same as coercion and it sounds to me like you were persuaded, not forced.

If it was heroin it would be a different story. But coke and crack makes people completely sharp and aware.
